INEC Restores David Mark as ADC National Chairman After Supreme Court Ruling

 



The Independent National Electoral Commission has reinstated Senator David Mark as the National Chairman of the African Democratic Congress following a Supreme Court judgment that nullified an earlier Court of Appeal directive.

The update, confirmed on the commission’s official website on Thursday night, also restored other members of the party’s National Working Committee, including former Osun State governor Rauf Aregbesola as National Secretary, Dr Mani Ahmad as National Treasurer, Akibu Dalhatu as National Financial Secretary, and Prof Oserheimen Osunbor as National Legal Adviser.

The commission had removed the names of the Mark-led leadership in April in compliance with a Court of Appeal order directing the maintenance of the status quo, a move that triggered protests from the affected faction and opposition figures.

The Supreme Court, however, overturned the directive on Thursday, ruling that the order to maintain the status quo could not subsist after the determination of the relevant proceedings. The court described its continued application as unnecessary and legally unsustainable.

In its judgment, the apex court also upheld the appeal filed by the Mark-led faction and directed that the substantive suit instituted by aggrieved party chieftain Nafiu Bala Gombe at the Federal High Court be heard expeditiously on its merits.

The dispute stems from a protracted legal battle over the recognition of Mark as National Chairman and the leadership structure of the party.

While the restoration has been welcomed by the Mark-led faction as a victory for due process and internal stability, the main suit challenging the legitimacy of the leadership remains pending before the Federal High Court.
