Supreme Court Vacates Appeal Court Order, Affirms David Mark as ADC National Chairman
The Supreme Court on Thursday vacated an order of the Court of Appeal that barred the recognition of David Mark as National Chairman of the African Democratic Congress.
In a unanimous judgment, Justice Mohammed Lawal Garba held that the preservative order issued by the appellate court was made in bad faith and described it as unnecessary, unwarranted and improper.
The apex court ruled that the Court of Appeal erred by granting an order that was not sought by any of the parties in the case.
The appellate court had earlier issued an order of status quo ante bellum, which led to the de-recognition of the ADC executive committee led by David Mark by the Independent National Electoral Commission.
With the order set aside, the judgment clears the way for the Independent National Electoral Commission to recognise David Mark and other national officers as the legitimate leadership of the party.
