The
Federal High Court in Abuja has fixed Friday, May 8, for the hearing of a leadership dispute case involving
Nafiu Bala and former Senate President
David Mark over control of the
African Democratic Congress.
The matter, filed under suit number FHC/ABJ/1819/2025, is before Justice Emeka Nwite.
The court date was set after hearing notices were issued to all parties following an application by Bala’s counsel, Luka Haruna, who requested accelerated hearing of the case.
In a letter dated May 5, 2026, Bala’s legal team informed the court that the interlocutory appeal filed by David Mark had been dismissed by the Supreme Court on April 30, 2026, clearing the way for hearing at the trial court.
The legal team, including Robert Emukpoeruo and Lukman Fagbemi, urged the court to proceed in line with the Court of Appeal’s directive for accelerated determination of the matter.
Justice Nwite had previously adjourned the case indefinitely on April 14, 2026, after Bala asked the court to await the outcome of proceedings at the Supreme Court.
However, the judge declined an application by the Mark-led ADC leadership seeking to hear all pending motions alongside the substantive suit.
Bala is asking the court to restrain David Mark, the party’s National Secretary, Rauf Aregbesola, and others from parading themselves as leaders of the party pending final determination of the case.
